Abstract

Planning the electricity and gas transmission grid to meet the requirements of the climate transformation requires greater consideration of uncertainties. This differs from the current planning process in that higher initial investments may be required to enable more resilient planning for an unknown target state and to keep the largest possible range of options open for the target year 2045. It may be possible to achieve “planning in options” without amending Sections 12a et seq. of the Energy Industry Act by interpreting undefined legal terms in the wording of the law in a way that takes greater account of the climate transformation. This approach could involve less time and administrative effort than an amendment to the law, but is associated with more legal uncertainty.
