Expert opinion on the draft of the Climate Compatibility Act of Mecklenburg-Western Pomerania

Abstract

With the Mecklenburg-Vorpommern Climate Compatibility Act (KlVG M-V), the state government of Mecklenburg-Vorpommern aims to create a long-term state legal framework for climate protection and adaptation to the consequences of climate change. As part of the parliamentary consultation on the draft bill, the Institute for Climate Protection, Energy and Mobility (IKEM) was asked to comment and answer an extensive list of questions. The statement focuses on sections 6 and 10 to 12 of the draft (KlVG M-V-E) as well as other central research topics of the IKEM.

The IKEM rates the draft KlVG M-V positively overall. The draft law sets out an ambitious and fundamentally coherent state legal framework for climate protection and adaptation in line with federal and European legal requirements.
It can make an effective contribution to implementing the climate targets, particularly if it is made more precise in individual points in order to further increase legal certainty, acceptance and speed of implementation.
The follow-up options identified by the IKEM include supplementing the monitoring process with accompanying scientific research, reviewing individual regulations on prioritizing land for photovoltaics, clarifying the system and scope of the requirement to take account of the public interest and regulating the “overriding public interest” for storage facilities. In the building sector, additional incentives and a consistent exemplary role for the public sector are recommended.
