Legal Overview: What Changes Were Made to Energy Transition Law in 2025?

Abstract

This article continues the series of annual reviews of developments in energy transition law. The authors provide an overview of what they consider to be the most significant changes in energy law. Although the collapse of the coalition at the end of 2024 brought about a political shift, the year 2025 nonetheless provided a boost to the energy transition: Through the implementation of European directives, accelerated permitting procedures for energy facilities were incorporated into national law. New legislation was enacted regarding the permanent storage and transport of carbon dioxide, and the legislature introduced the “energy sharing” model. The Federal Court of Justice (BGH) also ruled for the first time on the concept of a “customer-owned facility” following the highly publicized European Court of Justice (ECJ) ruling. Last but not least, the concept of climate neutrality was enshrined in the Basic Law in 2025. The article concludes with an outlook on the legislative amendments scheduled for 2026.
