The European Union’s climate law framework increasingly relies on mechanisms that structure and govern uncertain futures, rather than solely addressing present environmental issues. Binding climate neutrality targets, iterative planning obligations, revision clauses, regulatory sandboxes, the involvement of expert bodies, and the explicit role of strategic foresight in the “better regulation”-agenda illustrate a broader trend: EU law is embedding anticipatory governance as a core regulatory approach.
This paper conceptualizes these developments as the “seeds of a futurization of law”, where legal instruments proactively steer socio-technical, socio-ecological, and sustainability transformations under conditions of deep uncertainty. By examining the European Climate Law acquis and related fields of transformation, e.g. the Fit for 55 package, the Net-Zero Industry Act, and the Critical Raw Materials Act, the paper identifies how anticipation coordinates expectations across public and private actors, redistributes regulatory burdens over time, and reconfigures the temporal structure of legal authority.
The paper makes two main contributions. First, it develops a conceptual framework for understanding anticipation and futurization of law, questioning its operationalisation in EU climate governance. Second, it highlights the legal and constitutional tensions inherent in anticipatory governance, including challenges to democratic legitimacy, institutional competence, and judicial review. Situating these findings within debates on the role of law in transformation and the emergence of transformative law, the paper argues that anticipatory mechanisms are not only a necessary response to the temporal complexity of climate change, but also a formative step towards the broader futurization of legal governance. Understanding these developments is essential for designing (climate) law that is both effective and legitimate over the long term.
