Abstract

The article deals with the legal challenges of climate policy in the areas of land use and land use change (LULUC) and the hitherto particularly neglected area of soil protection. Based on a comparison of the legal and political systems in Brazil, Germany and the European Union, and South Africa and Africa as a whole, the existing legal frameworks are analyzed and proposals for their further development are put forward. The focus is on climate protection policy in terms of avoiding or storing greenhouse gases. Issues of climate adaptation are not the focus of this article, although soil and land use also play an important role in this context. This article deals with legal and legal policy issues of soil protection and land use from the perspective of climate protection.
