Abstract

The new Autonomous Driving Act (GAF) and the new Regulation on the Approval and Operation of Vehicles with Autonomous Driving Capabilities in Designated Operating Areas (AFGBV) establish the legal framework for the testing and regular operation of SAE Level 4 vehicles. These vehicles can perform driving tasks autonomously without a driver in a designated operating area and are equipped with the necessary technical equipment. A new position known as the “Technical Supervisor” has been created. This is a natural person who can deactivate the vehicle with autonomous driving capabilities during operation or authorize it to perform a specific driving maneuver. This study analyzes the role of the technical supervisor in order to provide legal support for the establishment of the supervisor’s position. To this end, the rights and obligations under the GAF and the AFGBV were legally assessed.
